What adjustments have been made in the newly revised implementation measures?


The first is to increase the intensity of reduction and replacement, and at the same time pay attention to adapting measures to local conditions and implementing policies by industry. The implementation measures stipulate that for cement clinker projects, except for the Tibet region, which continues to implement equivalent replacement, other regions will fully implement reduction replacement. Among them: For construction projects located in environmentally sensitive areas specified by the state, every ton of production capacity must be shut down and withdrawn. 1.5 tons of production capacity; for construction projects located in non-environmentally sensitive areas, 1.25 tons of production capacity must be shut down for every 1 ton of production capacity constructed. Flat glass projects continue the replacement ratio of the original method. For construction projects located in environmentally sensitive areas stipulated by the state, the number of production capacity that needs to be replaced and eliminated shall be verified at not less than 1.25 times that of the construction projects, and the same amount of replacement will be implemented in other areas.


The second is to limit the production capacity for replacement more strictly. The implementation measures are clear: the production capacity used for replacement should be the production capacity that has been shut down and withdrawn after January 1, 2018 on the portal of the provincial industry and information technology authority (hereinafter referred to as the provincial authority). At the same time, it is stipulated that the outdated production capacity that has exceeded the state's stated phase-out period, the retired production capacity that has enjoyed incentive funds and policy support, and the cement clinker production capacity without production license shall not be used for production capacity replacement. Of course, the production capacity that does not comply with the project construction procedures cannot be used for replacement. In order to prevent and eliminate possible fraudulent behaviors, the implementation measures not only reiterate that the production capacity indicators used for replacement shall not be reused, but also encourage industry associations, media and the public to supervise the implementation of the production capacity replacement plan and the construction of new projects.


Thirdly, the verification of production capacity indicators for replacement is more stringent. In view of the phenomenon of "approving small and building large" in the construction of cement clinker projects, in order to advocate trustworthiness and compliance with laws and regulations, the implementation measures stipulate that the production capacity index used for replacement shall be determined according to the design production capacity on the project filing or approval document. If the actual production capacity is less than the recorded or approved production capacity, it shall be determined according to the actual production capacity. The actual production capacity continues to be calculated according to the attached table of the original method, but in order to avoid the problem of confusing the inner diameter and outer diameter of the rotary kiln when estimating the production capacity of cement clinker, the implementation measures strictly require the outer diameter of the rotary kiln to be calculated.


For cross-provincial capacity replacement, the implementation measures emphasize that it should be conducive to promoting industrial structure adjustment and layout optimization.


The fourth is to further simplify the review process for capacity replacement plans. In order to deepen the reform of "delegating power, delegating power, regulating services" and improving industry management and services, the implementation measures stipulate that the provincial competent department of the project construction site is responsible for verifying the authenticity and compliance of the production capacity replacement plan, and publicizing it on the departmental portal without objection. At the same time, it is responsible for supervising the implementation of the production capacity replacement plan and determining the actual production capacity of the project. For production capacity indicators involving cross-provincial replacement, the provincial competent authority at the place where the project is constructed shall be well connected with the provincial competent authority where the production capacity indicator is transferred from.


What new content has been added to the newly revised implementation measures?


First, energy-saving and emission-reduction technical transformation projects that rely on the existing main equipment and do not increase production capacity may not formulate a capacity replacement plan. In order to encourage enterprises to independently carry out technological innovation and transformation, rely on existing main equipment, such as cement clinker rotary kiln and flat glass melting furnace, to carry out technical transformation projects aimed at pollution control, emission reduction, energy saving and consumption reduction without adding new production capacity, The implementation measures make it clear that a capacity replacement plan may not be formulated. In actual operation, the production enterprises only need to take the initiative to announce the status of the technical transformation project, promise to ensure that the actual production capacity of cement clinker or flat glass will not be expanded, and at the same time consciously accept the supervision.


Second, industrial glass projects with a newly installed furnace capacity of not more than 150 tons per day may not formulate a capacity replacement plan. In order to encourage enterprises to develop and produce high-end flat glass for industrial use, the implementation measures clarified that new industrial glass projects with a furnace capacity of not more than 150 tons per day do not need to formulate a capacity replacement plan. In practice, glass companies only need to file the project truthfully, and at the same time, actively announce the key main equipment of the project, and consciously accept supervision, but must not use the name of developing industrial glass to build new flat glass capacity projects.


The third is to allow the phenomenon of “build first and then demolition” in the capacity replacement plan. In order to better deal with the relationship between technological progress and reduction of excess production capacity, which is conducive to the normal production and operation of enterprises, the implementation measures stipulate that the production capacity used for construction project replacement must be shut down before the construction project is put into production, and demolished within one year of the construction project being put into production. quit. This actually allows the phenomenon of "build first and then demolition", that is, after the capacity for replacement is announced and before it is shut down and demolished, construction projects can start construction. In actual operation, the provincial competent department of the project construction site should effectively supervise and guide the enterprise, abide by the promise and pay attention to integrity, ensure that the production capacity for replacement is shut down before the new project is put into operation, and the original production line is dismantled within one year of the new project being put into operation, and Announcements on shutdown, production, and demolition activities were issued in a timely manner, and consciously accepted supervision.


The fourth is to increase punishment and accountability.
